Statement of Rights & Fair Criticism
Why this publication is fully lawful, non-infringing, constitutionally protected, and conducted strictly in the public interest.
Nominative Fair Use & Zero Trademark Infringement
This website (linkedinrestricted.com) is an independent publication dedicated to consumer criticism, documented accountability, and public interest journalism. It is not affiliated with, operated by, sponsored by, or endorsed by LinkedIn Corporation, Microsoft Corporation, or any of their affiliates.
The trademark "LinkedIn" is used strictly under the legal doctrine of nominative fair use (and Section 30 of the Indian Trade Marks Act, 1999), which permits the use of a third-party mark to accurately refer to and identify the entity whose services and policies are the subject of commentary and grievance.
- The site does not copy or spoof LinkedIn's proprietary logos or visual trade dress.
- The visual identity uses Obsidian Black, Amber, and Crimson—completely distinct from LinkedIn's corporate blue.
- There is zero potential for consumer confusion: no user could reasonably mistake this critical dossier for an official corporate property.
Constitutional Protection under Article 19(1)(a)
Under Article 19(1)(a) of the Constitution of India, citizens possess the fundamental right to freedom of speech and expression. This encompasses the right to publish truthful accounts of consumer grievances, share verifiable primary correspondence, and critique corporate policies that affect their livelihood and reputation.
Truth is an absolute defense to defamation. Every factual statement, date, and quote presented on this platform is backed by primary source documents—including official emails from LinkedIn Trust & Support, the India Grievance Officer, and the Government of India's Grievance Appellate Committee (GAC).
Platform Monopoly & Digital Labor Lock-in
LinkedIn operates as the undisputed global monopoly for professional networking, corporate hiring, and digital career identity. When a platform achieves this degree of network dominance, an account is no longer merely a casual social media handle—it represents a professional's verified identity, peer recommendations, industry connections, and economic livelihood.
When LinkedIn permanently excludes a Lead Product Manager with 12+ years of unblemished tenure for manually opening 15–20 coworker tabs, and declares that "you are prohibited for life from ever creating a future account", the penalty is grossly disproportionate to the alleged conduct. Monopolistic gatekeepers cannot act as private courts issuing career-ending bans without basic accountability.
Violations of Natural Justice (Audi Alteram Partem)
A cornerstone of Indian and international jurisprudence is the principle of Audi alteram partem ("listen to the other side"). A party cannot be condemned or deprived of significant rights without being heard or given a reasoned explanation.
LinkedIn's grievance handling failed basic tenets of natural justice:
- Refusal of Reasons: Support consultant Max stated that LinkedIn does not provide an interpretation of what rule was violated, advising the user to hire a lawyer.
- Inconsistency: At 15:01, LinkedIn officially declared the account temporarily suspended and promised auto-restoration; 32 minutes later, it imposed a permanent lifetime ban without explanation.
- Mechanical Adjudication: Agent Ramesh S leaked internal macro scripts ("**ONLY if second offense..."), proving the appeal was processed with a pre-written macro rather than an individualized human review.
Statutory Regulatory Appeal: GAC Appeal No. 133672/2026
Under Rule 3A of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, any person aggrieved by an order of an intermediary's Grievance Officer may prefer an appeal to the Grievance Appellate Committee (GAC) established by the Central Government.
Having exhausted all internal remedies under LinkedIn's support hierarchy, Avinash Singh duly filed Appeal No. 133672/2026 on 24 July 2026. As of the latest official report, the appeal is recorded as "Under Process". This campaign scrupulously respects this process and documents only verifiable facts.
